A federal judge on Friday ordered the Trump administration to restart the DACA program, concluding that while the executive branch has the power to rescind the Obama-era program, the administration didn’t prove that it has considered the benefits of having illegal immigrants in the country compared to the government’s interest in enforcing immigration laws.

However, the Trump administration is being given a chance to appeal before having ti comply with the order.

“The court sees no reason to change its earlier determination that DACA’s rescission was arbitrary and capricious,” Judge John D. Bates ruled.
